Welcome to PERKD! These Consumer Terms of Use ("Terms") govern your access to and use of the PERKD website, mobile experience, QR/NFC experiences, PERKD Spots, perks, promotions, and related services (collectively, "PERKD"). By creating an account or using PERKD, you agree to these Terms.
PERKD is a local discovery platform that connects consumers with participating businesses through physical PERKD Spots located at participating properties.
PERKD users may discover exclusive offers ("Perks") from participating businesses, save eligible Perks, redeem Perks subject to their terms, and participate in promotional experiences offered through PERKD.
PERKD does not provide the underlying products or services offered by participating businesses. Purchases and services are provided directly by the applicable business.
You must be at least 18 years old to create a PERKD account unless PERKD expressly provides otherwise.
Certain promotions, including the PERKD Pot, may have additional eligibility requirements described in their applicable Official Rules.
You may create only one PERKD account per person.
You agree to provide accurate and current information when creating and maintaining your account.
PERKD may use phone, email, device, or other reasonable verification methods to help protect accounts and prevent misuse.
You may not:
PERKD may suspend, restrict, or terminate accounts reasonably believed to be involved in fraud, abuse, manipulation, or violations of these Terms.
Participating PERKD Spots may feature rotating groups of participating businesses and Perks.
Businesses, offers, availability, locations, and promotional terms may change from week to week.
Scanning or tapping a PERKD Spot does not guarantee that any particular business, category, product, service, discount, or Perk will be available.
Each participating business determines the terms of its Perk in coordination with PERKD.
A Perk may include conditions such as:
These conditions will be displayed with the applicable Perk when appropriate.
Users are responsible for reviewing the terms before saving, purchasing, booking, or redeeming a Perk.
Perks have no cash value unless expressly stated otherwise and may not be exchanged for cash.
PERKD may remove, modify, pause, or discontinue a Perk when reasonably necessary, including when a participating business changes or withdraws an offer.
Saving a Perk does not necessarily guarantee availability.
Some Perks may have limited quantities or redemption capacity and may become unavailable before their stated expiration date.
When redeeming a Perk, you may be required to present the Perk through your PERKD account and complete the redemption process at the participating business.
Once a single-use Perk has been redeemed, it may no longer be used.
PERKD may use redemption records to prevent duplicate use and provide participating businesses with performance reporting.
Participating businesses are independent businesses and are not employees, agents, partners, or representatives of PERKD solely because they participate in the PERKD network.
Businesses remain responsible for their own products, services, pricing, appointments, customer service, licenses, safety, fulfillment, and compliance with applicable law.
Any purchase or service relationship you enter into with a participating business is between you and that business.
If you experience a problem with a business or Perk, you may report the issue to PERKD so that we can review the business's continued participation in the network.
PERKD may periodically offer sweepstakes, giveaways, drawings, or other promotions, including the "PERKD Pot."
The PERKD Pot is governed by separate Official Rules, which will describe eligibility, entry methods, entry limits, prize calculation, prize limits, winner selection, verification requirements, deadlines, and other applicable conditions.
Where required by law, no purchase is necessary to enter or win, and a purchase will not increase the odds of winning.
Scanning or tapping a PERKD Spot may provide an eligible user with an opportunity to earn an entry subject to the applicable Official Rules.
Repeated scanning does not necessarily result in additional entries.
PERKD may limit entries to one eligible entry per verified user during a specified period, such as once per week.
The PERKD Pot amount may increase based on eligible participation according to the formula and limits stated in the applicable Official Rules.
Potential winners may be required to complete identity, age, residency, eligibility, or other reasonable verification before receiving a prize.
Accounts or entries associated with fraud, manipulation, duplicate accounts, automated activity, or violations of the Official Rules may be disqualified.
PERKD Spots may be located at apartment communities and other participating properties.
Access to a PERKD Spot does not provide a user with permission to enter private, restricted, residents-only, employee-only, or otherwise controlled property.
You may only access PERKD Spots located in areas you are independently authorized to access.
Do not trespass, follow residents into secured areas, bypass access controls, or enter a property solely to obtain a PERKD entry when you are not authorized to be there.
PERKD may restrict certain PERKD Spots or promotions to residents, guests, employees, students, or other eligible users associated with a participating property.
By creating a PERKD account, you may receive service-related communications necessary to operate your account, such as verification codes, security alerts, redemption confirmations, account notices, and important changes to PERKD.
Marketing emails or text messages will be handled according to the consent choices presented to you.
Where required, you may unsubscribe from marketing communications without losing access to essential account communications.
You agree to use PERKD lawfully and respectfully. You may not attempt to:
PERKD may add, remove, change, suspend, or discontinue features, participating properties, businesses, Perks, or other portions of the service.
Temporary interruptions may occur due to maintenance, technology failures, internet availability, participating property conditions, business availability, or circumstances outside PERKD's reasonable control.
PERKD's name, branding, designs, software, graphics, content, interfaces, and other proprietary materials belong to PERKD or its licensors and are protected by applicable intellectual property laws.
Participating business names, logos, trademarks, photographs, and other business materials belong to their respective owners.
You may use PERKD solely for your personal, lawful use.
Your use of PERKD is also governed by the PERKD Privacy Policy.
The Privacy Policy explains how PERKD collects, uses, stores, and shares information associated with your use of the service, including information related to accounts, PERKD Spot interactions, Perk activity, and redemptions.
PERKD facilitates discovery and promotional connections between users and independent participating businesses.
To the extent permitted by applicable law, PERKD does not guarantee the quality, safety, availability, suitability, legality, or performance of products or services provided by participating businesses.
Nothing in these Terms limits rights or remedies that cannot legally be waived.
To the maximum extent permitted by applicable law, PERKD and its owners, employees, contractors, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of PERKD or your interactions with participating businesses.
Any limitations in this section apply only to the extent permitted by applicable law.
PERKD may suspend or terminate access when reasonably necessary to protect PERKD, its users, participating properties, participating businesses, promotions, or the integrity of the platform.
Reasons may include fraud, duplicate accounts, manipulation of promotional entries, repeated misuse of Perks, falsified redemptions, unauthorized access, or other material violations of these Terms.
PERKD may update these Terms as the service develops.
When material changes are made, PERKD will provide notice as required by applicable law. Continued use following the effective date of updated Terms constitutes acceptance where legally permitted.
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
